Applies to: All Evoke Services – Free Guided Setup, Evoke Vault, and Advisory Packages

1. Introduction

These Terms of Service ("Terms") govern your access to and use of services provided by Evoke Digital Solutions Ltd. By using our services—whether free or paid—you agree to these Terms. If you do not agree, do not use our services.

2. Service Definitions

• Guided Setup: Our free tier. A self-service walkthrough and instructional content to help you set up a multi-signature Bitcoin wallet using your own devices.

• Evoke Vault: A paid service where Evoke holds one recovery key in a 2-of-3 multi-signature wallet structure. You retain full control and access.

• Advisory Services: Bespoke consultancy for individuals or businesses that includes custody strategy, inheritance preparation, governance support, and multi-sig wallet implementation.

3. Nature of Services

All Evoke services are strictly non-custodial and non-regulated.

• We do not store, manage, or control your Bitcoin at any time.

• We do not provide regulated financial, legal, or tax advice.

• Our services are educational, technical, and strategic in nature.

4. Tier-Specific Terms

4.1 Guided Setup (Free)

• Self-directed educational materials only.

• No live wallet creation, no recovery support, no key-holding.

• You are fully responsible for securing your keys, following instructions, and testing your wallet setup.

• Evoke accepts no liability for any loss resulting from use of the Guided Setup materials.

4.2 Evoke Vault (Key-Holding)

• Evoke holds one key in a 2-of-3 multi-sig wallet.

• We cannot move funds on our own and will only act to help recover access when authorised by you.

• You remain responsible for holding the other two keys securely.

• If Evoke becomes unavailable, and you lose your other keys, you may lose access permanently.

• A separate key-holding agreement governs specific terms, including emergency access protocols and annual fee structure.

4.3 Advisory Services (Paid)

• Services may include live consultations, technical setup assistance, governance policy creation, inheritance structure planning, and education.

• We will never access or control funds on your behalf.

• You are advised to seek your own legal, tax, and investment advice before making any decisions related to digital assets.

• All recommendations are for educational and strategic purposes only.

5. Fees & Payment

• Guided Setup is provided free of charge.

• Evoke Vault and Advisory Services are subject to fees outlined in your engagement letter or onboarding form.

• All paid fees are non-refundable unless otherwise stated in writing.

6. Your Responsibilities

You agree to:

• Use our services responsibly and for lawful purposes only.

• Maintain control and backups of your private keys and wallet recovery phrases.

• Understand that cryptocurrency transactions are irreversible and carry risk.

• Not rely on Evoke as a recovery provider unless explicitly covered under the Vault service.

7. Disclaimers

• Evoke is not regulated by the Financial Conduct Authority (FCA) or any other authority.

• Nothing on our website, documentation, or during calls should be interpreted as regulated advice.

• Use of digital assets carries inherent risk. You may lose access to funds permanently if you mismanage your setup.

• We make no guarantees about wallet functionality, blockchain security, or future regulatory treatment of digital assets.

8. Limitation of Liability

To the fullest extent permitted by law:

• Evoke shall not be liable for any direct, indirect, incidental, or consequential loss related to your use of our services.

• This includes, but is not limited to, loss of Bitcoin, loss of access, or financial damages resulting from user error, misconfiguration, reliance on our guidance, or third-party breaches.

9. Privacy

Any personal information you provide will be handled in accordance with our Privacy Policy, which complies with the UK GDPR.
We do not sell or share your information without your consent.

10. Intellectual Property

All materials, guides, videos, diagrams, and documentation provided by Evoke are the intellectual property of Evoke Digital Solutions Ltd.
They may not be copied, redistributed, or repurposed without our written consent.

11. Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the English courts.
